This act improves the options for verifying and using information from the AIVD during criminal proceedings in a number of ways. For example, it creates two special procedures that allow the examining magistrate to assess the reliability of an official report from the intelligence and security services while protecting the witness.
The more complicated procedure (sections 226g-226m) enables an officer of the AIVD (or MIVD – the Military Intelligence and Security Service) to testify as a protected witness, either anonymously or otherwise. The less complicated procedure provides for the protection of certain information for reasons of national security during a regular examination by the examining magistrate.
